2. Applicability

2.1. These terms and conditions apply to all agreements, offers, and services provided by SealGrip, including the certification of physical artworks using NFC chips and digital certificates of authenticity.

2.2. By purchasing or using our services, the customer agrees to these terms and conditions.

3. Products and Services

3.1. SealGrip offers a combination of physical products (NFC chips) and digital certificates of authenticity, sold per certified artwork rather than as a subscription.

3.2. Each certificate is permanently and cryptographically bound to the NFC chip attached to the corresponding physical work.

3.3. The customer is responsible for ensuring that the NFC chip is used in accordance with the instructions provided. SealGrip is not responsible for any damage or misuse of the NFC chips.

4. Liability

4.1. SealGrip is not liable for any direct, indirect, incidental, or consequential damages resulting from the use of our products or services, except in cases of gross negligence or willful misconduct.

4.2. SealGrip is not responsible for any damage or loss resulting from unauthorized access to or use of the digital certificates.

4.3. The customer acknowledges that the use of NFC technology may be subject to technical limitations and risks. SealGrip is not liable for any interruptions, delays, or errors in the transmission of data.

5. Privacy and Data Protection

5.1. SealGrip complies with the General Data Protection Regulation (GDPR) and European data protection laws.

5.2. Personal data collected during onboarding and verification will only be used for the purpose of fulfilling the agreement and will not be shared with third parties without the customer's explicit consent.

5.3. Customers have the right to access, rectify, or delete their personal data. Requests can be made via the contact information provided above.

6. Payment and Pricing

6.1. All prices are inclusive of VAT and other applicable taxes, unless stated otherwise.

6.2. Certificates are billed per artwork at the time of purchase, and can be made via the payment methods specified on our website. A one-time verification fee applies to new artists, as described separately.

6.3. SealGrip reserves the right to adjust prices. Customers will be notified of any price changes before they take effect.

7. Cancellation and Termination

7.1. As certificates are sold individually rather than as a subscription, there is no recurring cancellation process; each certificate purchase is a one-time transaction.

7.2. SealGrip reserves the right to refuse or terminate service without notice in cases of misuse, fraud, or breach of these terms and conditions.

8. Governing Law and Jurisdiction

8.1. These terms and conditions are governed by European law.

8.2. Any disputes arising from these terms and conditions will be subject to the exclusive jurisdiction of the competent courts in the Netherlands.

9. Amendments to Terms and Conditions

9.1. SealGrip reserves the right to amend these terms and conditions at any time. Customers will be notified of any changes via email or through our website.

9.2. Continued use of our products and services after amendments to these terms and conditions constitutes acceptance of the revised terms.
